Even unmanaged debts must be dealt legally
Insolvency law sets the boundaries for creditors and debtors on how to behave towards each other in a crisis. Sometimes it is simply not possible to pay everything, and a partial satisfaction of all is better than a partial victory of the strongest. Particularly in this sector, careful analysis of the contractual partner, precaution and prudence in legal relations and, last but not least, proper security of one's rights are important.
In my expertise, I focus in particular on the following:
- Creditors’ bodies (representation of creditors at the creditors' meeting or in the creditors' committee)
- Legal advice to debtors (defending against unjustified insolvency petitions)
- Exercising creditors' rights (claims against the property estate, applications for claims)
- Insolvency of commercial corporations and its resolution (bankruptcy, reorganization)
- Bankruptcy of natural persons (debt relief)
- Representation before the insolvency court
